Labour Protection Act Amendment: Maternity Leave Extended to 120 Days勞動保護法修正案:產假延長至120天

The Senate passed the Labour Protection Act (Amendment) on maternity leave of 120 days on 15 September 2025. The Act will come into force 30 days after its publication in the Royal Gazette and will become the 9th revision of the Labour Protection Act, updating its provisions to be more modern and in line with current needs.

參議院於2025年9月15日通過關於120天產假的勞動保護法(修正案)。此法案將在皇家公報上公告後30天生效,並將成為勞動保護法的第9次修訂、更新條款,使此法更加現代化並符合當前的需求。

 

The amendment bill passed its final reading with 125 votes in favor, while five senators abstained.

此修正案以125票贊成、5票棄權的成績獲得最終通過。

During the second reading, when the bill was considered article by article, the senators agreed with the details already endorsed by the House of Representatives.

在二讀時,當逐條審議此法案,參議員們同意眾議院已經同意的細節。

 

The key provisions of this Labour Protection Act amendment are as follows:

本次勞動保護法修正案的主要內容如下:

Þ  Contract workers are entitled to work compensation, weekly holidays, public holidays, annual leave, sick leave, maternity leave, etc., not less than the rights specified under the Labour Protection Act.

合約制員工享有不低於《勞動保護法》規定權利的勞動報酬、每週休假、國定假日、年假、病假、產假等。

  1. Female employees are entitled to 120 days of maternity leave, with full pay for the first 60 days from the employer.

女性員工有權享有120天的產假,其中前60天由雇主支付全薪。

  1. Female employees are entitled to an additional 15 days of leave to care for a child who is ill, at risk of complications, has abnormalities, or has a disability, receiving 50% of their salary during this period.

女性員工有權享有額外 15 天的假期照顧生病、有併發症風險、有異常或殘疾的孩子,在此期間可獲得 50% 的薪資。

  1. Employees are entitled to 15 days of leave to assist their spouse who has given birth, with full pay throughout the 15-day childcare leave.

員工有權享有 15 天的假期協助生育的配偶,並在 15 天的育嬰假期間可享有全額薪資。

The Senate is now preparing to submit the bill to the Prime Minister for royal assent and subsequent publication in the Royal Gazette.

參議院目前正準備將法案提交給總理,以獲皇家御准,並公告在皇家公報。

 

This Labour Protection Act amendment represents a significant first step in improving welfare and fundamental rights for workers in Thailand and helps reduce social inequality among the workforce.
