New Contract Regulations for Beauty Industry are Issued in Thailand泰國推出美容業合約新規定

On 26 September 2025, the Contract Committee under Thailand’s Office of the Consumer Protection Board has issued Notification on Prescribing the Beauty Service Business as a Contract-Controlled Business B.E. 2568 (2025), which aims to standardize service contracts, bans certain unfair clauses, and enhance consumer protection within the beauty industry. The regulation will be effective on 24 January 2026, and business operators are required to use a prescribed standard contract in Thai and adhere to strict mandatory provisions and prohibitions.
泰國消費者保護委員會辦公室合約委員會於2025年9月26日發布《佛曆2568年(2025) 關於將美容服務業納入合約管理的通知》,目的在規範服務合約、禁止某些不公平條款、加強對美容行業的消費者保護。此法規將於2026年1月24日生效,要求企業經營者使用規定的泰語標準合約,並遵守嚴格的強制性條款和禁令。
These regulations apply to operators across all in-person and online service channels, including via digital platforms. Business operators will need proper contracts to provide beauty services to customers, or could face legal implications. The notification includes below key requirements:

Mandatory formality and terms

Service contracts must use the standard contract form, in Thai, with clear, readable text (minimum font size of 2 millimeters, no more than 11 characters per inch), and include all essential terms from the annexed form. The contracts must be prepared in duplicate and provided to customers. The changes will affect the current market practices, including the customary use of verbal agreements or informal contract formats.
服務合約必須使用泰語標準合約格式,文字清晰易讀(字體大小至少為2毫米,每英吋不超過11個字元),並包含附件表格的所有必要條款。合約必須一式兩份並提供給客戶。這些變化將影響目前的市場慣例,包括慣常使用的口頭協議或非正式合約格式。
The mandatory form also introduces the customer rights, including the right to change doctors or therapists, the right to terminate the contract in many circumstances, and the right to a full refund within seven days of purchase, provided that no services have been used, and the right to a proportional refund if the business closes, undergoes renovations, or relocates, with a clearly specified refund period.
此強制性格式也同時載明顧客權益,其中包括更換醫師或治療師的權利、在多數情況下終止合約的權利,以及在購買後七天內、且未使用任何服務的情況下獲得全額退款的權利。如果企業關閉、裝修或搬遷,有權按比例退款,並明確規定退款期限。

For agreements concluded through electronic channels, the process must comply with the Electronic Transactions Act

Prohibited terms

One-sided clauses commonly used in the market are removed. For example:

Ø Clauses that limit or exclude liability for damages to life, body, health or property.
限制或排除對生命、身體、健康或財產損害賠償責任的條款。
Ø Clauses giving the operator a unilateral right to change services or fees in a way that makes the consumer worse off.
賦予經營者單方更改服務或費用,且使消費者權益受損的條款。
Ø Clauses that permit termination without notice and automatically renew contracts
允許無預先通知即終止合約,並自動續約的條款。
Ø Clauses that bind consumers to business operators’ rules without consent
未經消費者同意即約束消費者遵守經營者規則的條款。
Ø Clauses that misuse personal data in violation of the Personal Data Protection Act.
違反個人資料保護法濫用個人資料的條款。
Non-compliance will lead to criminal penalties. Businesses that do not comply with the mandatory formality or terms could face imprisonment of up to one year, a fine of up to THB 200,000, or both.
不遵守規定將導致刑事處罰。不遵守強制性格式或條款的企業可能面臨最高一年監禁、最高20萬泰銖罰款,或兩者併罰。
