New Obligations for Online Marketplaces in Thailand泰國網購平台的新義務

On 9 July 2025, Thailand issued a notification that brings in comprehensive operational requirements for digital platform service (DPS) providers operating as goods marketplaces. The notification will be effective 180 days after its publication in the Government Gazette, which is 31 December 2025. The official name of the regulation is Notification of the Electronic Transactions Committee Re: Other Actions for Digital Platform Service Operators in the Category of Marketplace for Goods with Specific Characteristics under Section 18(2) of the Royal Decree on the Operation of Digital Platform Service Businesses that are Subject to Prior Notification B.E. 2565 (2022), B.E. 2568 (2025).
泰國於2025年7月9日發布通知,對作為商品交易市場運營的數位平台服務(DPS)供應商提出全面的營運要求。此通知將於政府公報公佈後180天起生效,即2025年12月31日。法規的正式名稱是”佛曆2568年(2025) 電子交易委員會通知: 根據佛曆2568年(2022)《關於須事先通知的數位平台服務業務運營的皇家法令》第 18(2) 條,針對特定特徵商品交易市場類別的數位平台服務運營商的其他行動”。
The notification applied exclusively to goods marketplace operators formally designated by the Electronic Transactions Development Agency (ETDA), which on the same day designated 19 major platforms that had previously notified the ETDA of their operations, such as Shopee, Lazada, Grab, AliExpress, and eBay. The designation of these 19 platforms as marketplaces for goods with specific characteristics was based on factors such as risks to financial and commercial security, reliability and acceptance of electronic data systems, and the potential for significant harm to the public, in accordance with Section 18(2) of the Royal Decree. The goods requiring enhanced oversight by these operators are limited to those regulated by the Thai Food and Drug Administration (FDA) and the Thai Industrial Standards Institute (TISI).

However, there are still a large number of digital platforms currently under further review. If the ETDA finds that they meet the specified criteria, additional platforms will be announced in due course. Under Section, 24 the list of designated platforms must be reviewed annually, which means that the list may be expanded, reduced, or otherwise adjusted in accordance with changes in the nature of digital platform services.

The platforms are deemed “high-risk”, and the Thai authorities expect that the regulations will contribute to protect consumers from online fraud, ensure transparency and accountability from platform providers, and enable government agencies to effectively track, monitor, and regulate digital platforms.

Below is the additional obligations on designated goods market operators:

Transparency: Operators must conduct robust transparency measures, including clear, accessible, and understandable disclosures to users in Thai. These disclosures must cover all relevant terms and conditions, comprehensive product information, and complaint management procedures. In addition, operators must submit an annual compliance report to the ETDA in 60 days after the end of the accounting period, which include statistics on regulated goods.
透明度:營運商必須採取強有力的透明度措施,包括向泰語使用者提供清晰、易懂且易於理解的公開資訊。這些公開資訊必須涵蓋所有相關條款和條件、全面的產品資訊以及投訴管理程序。此外,營運商必須在會計期間結束後 60 天內向 ETDA 提交年度合規報告,其中包括受管製商品的統計資料。
Verify Merchant Identities: operators must collect and verify business user information, including contact details, identification documents, registration numbers, bank account details, and self-certification of legal compliance before allowing the sale or advertisement of regulated goods.
驗證商家身份:運營商在允許銷售或宣傳管制商品之前,必須收集和驗證商業用戶資訊,包括聯繫方式、身份證件、註冊號碼、銀行帳戶詳細資訊以及法律合規性的自我證明。
Monitor Product Listings: Operators must establish and carry out policies requiring business users to display evidence of compliance before listing regulated products. The product listing policies must forbid listing prohibited merchandise, such as IP-infringing goods.
上架監控產品:營運商必須制定並執行相關政策,要求企業用戶在上架監管產品前提供合規證明。產品上架政策必須禁止上架違禁商品,例如侵害智慧財產權的商品。
Punishment for noncompliant business users: Operators must stating in their terms of service that when business users fail to provide accurate or complete documentation, their service may be suspend for up to 30 days, with written notice and an opportunity to respond.
對不合規商業用戶的處罰:運營商必須在服務條款中規定,當商業用戶未能提供正確或完整的文件,其服務可能會被暫停長達 30 天,並以書面通知和回應機會。
In addition, the ETDA recently issued a directive listing digital platforms in the goods market that must comply with Section 20 of the DPS Act, which has been effective from 10 July 2025. The platforms include those generating over 1.8 million THB in revenue annually in Thailand or those with more than 5,000 users per month. The platforms should notify the ETDA about their service. Furthermore, the high-risk platforms must increase monitoring of sellers, products, and advertisement. Failure to comply with reporting requirements or operational duties could result in service suspension or fines as stipulated by law.
此外,ETDA 最近發布一項指令,列出必須遵守 DPS 法第 20 條的商品市場數位平台,此指令自 2025 年 7 月 10 日起生效。這些平台包括在泰國年收入超過180萬泰銖或每月用戶超過5,000人的平台。這些平台應向ETDA通知其服務情況。此外,高風險平台必須加強對賣家、產品和廣告的監控。不遵守報告要求或營運職責可能導致法律規定的服務暫停或罰款。
