The Central Intellectual Property and International Trade Court (“CIPITC”) is established in 1997, and it handles intellectual property cases and international trade cases all over Thailand. The relevant law related to CIPITC is the Act for the Establishment of and Procedures for the Intellectual Property and International Trade Court B.E. 2539 (1996).
泰國中央智慧財產權及國際貿易法院(簡稱” CIPITC”) 於1997年成立，主要處理泰國與智慧財產權以及國際貿易有關的案件。與CIPITC有關的法律為佛曆2539年(西元1996年) 《智慧財產權及國際貿易法院的成立及程序法》。
According to section 7 under the Act, CIPITC has power to adjudicate following cases:[1]
依據《智慧財產權及國際貿易法院的成立及程序法》第7條規定，CIPITC有權處理以下案件:
(1) Criminal cases regarding trademarks, copyrights, and patents;
與商標、著作權和專利有關的刑事案件；
(2) Criminal cases regarding offenses under Section 271-275 of the Criminal Code;
與《泰國刑法》第271-275條規定犯罪有關的刑事案件；
(3) Civil cases regarding trademarks, copyrights, and patents and cases arising from
agreements on technology transfers or licensing agreements;
與商標、著作權和專利有關的民事案件以及技術移轉協議或授權協議引發的案件；
(4) Civil cases in connection with Section 271-275 of the Criminal Code;
與《泰國刑法》第271-275條有關的民事案件；
(5) Civil cases regarding international sale, exchange of goods or financial
instruments, international services, international carriage, insurance and other
related juristic acts;
與國際銷售、貨物或金融工具交易、國際服務、國際運輸、保險和其他相關法律行為有關的民事案件；
(6) Civil cases regarding letters of credit issued in connection with transactions under
item (5), inward or outward remittance of funds, trust receipts, and guarantees in
connection therewith;
與根據第（5）項交易發出的信用狀、資金匯入或匯出、信託收據以及相關擔保有關的民事案件；
(7) Civil cases regarding arrest of ships;
與扣船有關的民事案件；
(8) Civil cases regarding dumping and subsidization of goods or services from abroad;
與從國外傾銷和補貼商品或服務有關的民事案件；
(9) Civil or criminal cases regarding disputes over layout-designs of integrated
circuits, scientific discoveries, trade names, geographical identifications, trade
secrets, and plant varieties protection;
與集成電路配置設計、科學發現、商業名稱、產品地理標誌、營業秘密和植物品種保護有關的民事或刑事案件；
(10) Civil or criminal cases that are prescribed to be under the jurisdiction of the
Intellectual Property and International Trade Courts;
由智慧財產權及國際貿易法院管轄的民事或刑事案件：
(11) Civil cases regarding arbitration to settle disputes under (3) – (10)
與仲裁處理第(3)–(10)項有關的民事案件。
Cases falling under the jurisdiction of Juvenile and Family Court shall not be under the jurisdiction of the Intellectual Property and International Trade Courts.
少年法院及家庭法院管轄範圍內的案件不屬於智慧財產權及國際貿易法院的管轄範圍。
Furthermore, there are some more details of CIPITC:
除此之外，CIPITC有以下規定：
1. Every Intellectual Property and International Trade Court shall have career judges and associate judges in the number determined by the Executive Committee of the Court of justice.[2]
每個知識產權和國際貿易法院均應設有職業法官和助理法官，其人數由法院執行委員會決定。
2. Any cases arising outside the jurisdiction of CIPITC may be filed, but CIPITC has right to determine whether to reject such cases.
CIPITC管轄外的案件仍可進行提交，但CIPITC有決權定是否要受理。
3. If any party isn’t satisfied with decision made by CIPITC, an appeal may be filed before Supreme High Court.
對於CIPITC裁定不服的案件可向最高法院上訴。
4. It has developed a technology system to hold a trial via online conference when a witness resides in a remote place.[3]
如證人住在遙遠的地方CIPITC可進行線上審訊。
5. Translation of a document can be neglected if it is agreed by the other party and proved that such document does not directly relate to the main issue.[4]
經證明非主要資料的證據資料如另一方同意可不需進行翻譯。
