Two Bills is Drafted to Expend Leave and Workers’ Rights in Thailand 泰國起草兩項延長休假和工人權利的法案

On 24 September 2025, the House of Representatives voted to approve two draft amendments to the Labor Protection Act in their first reading. Both proposals aim to strengthen the rights and welfare of more than 30 million workers nationwide and were sent to special committees for further review within 15 days.

眾議院於2025年9月24日一讀投票通過《勞動保護法》的兩項修正案草案。這兩項提案均旨在加強全國超過3000萬工人的權利和福利,並在15天內送交專門委員會進一步審查。

 

Draft Bill on Workers’ Rights:[1]

工人權利法案草案:

This draft focuses on working conditions. It limits the standard work week to 40 hours, or 35 hours for hazardous occupations, and requires employers to provide at least 2 weekly holidays with no more than 5 days consecutive working days between rest days. Employees who have worked 120 consecutive days will be entitled to not less than 10 days of annual leave.

此草案重點關注工作條件。每週標準工作時間限制為 40 小時,危險職業為 35 小時,並要求雇主提供至少2個每週假期,休息日之間的連續工作日不得超過 5 天。如勞工連續工作滿120天,享有不少於10天的年休假。

 

Draft Bill on Workers’ Quality of Life:[2]

工人生活品質法案草案:

This draft aims to enhance workers’ quality of life and promote equality and nondiscrimination in the workplace, ensuring equal treatment of male and female employees in all aspects, including recruitment, promotion, remuneration, and benefits. It prohibits all forms of workplace discrimination, allows leave to care for family members in their final moments of life. Employees are entitled to up to 15 working days per year to care for close family members or loved ones. For absences of 5 or more days, employers may request supporting documents such as a medical certificate or death certificate. In addition, employers should provide breastfeeding facilities at the workplace, where employees can breastfeed at least twice per workday, 30 minutes each session, for at least 1 year after childbirth. The draft also introduces menstrual leave for female employees up to 3 days per month, which is not counted as sick leave.

此草案旨在提高工人的生活質量,促進工作場所的平等和非歧視,確保男女員工在招聘、升遷、薪酬和福利等各方面享有平等待遇。禁止一切形式的工作場所歧視,允許在家人生命的最後時刻照顧他們。員工每年有權有最多 15 個工作天照顧親密的家庭成員或親人。如果缺勤5天或以上,雇主可以要求提供證明文件,例如醫療證明或死亡證明。此外,雇主應在工作場所提供母乳哺育設施,員工在產後至少1年內每個工作日至少可以哺乳兩次,每次 30 分鐘。草案也規定,女性員工每月最多可享有3天生理假,且不計入病假。
