Thailand Offers Tax Breakers for Investment Token Issuers 泰國為投資代幣發行人提供稅收優惠

On 7 March 2023, Thailand’s cabinet agreed to waive corporate income tax and value-added tax for companies issuing digital tokens for investment, to facilitate fund-raising by listed and non-listed entities. In addition, the policy is applicable in both primary and secondary markets for companies and registered entities issuing initial coin offerings.


What is digital investment token?


Digital investment tokens are digital token that defines a person's right to participate in any project or venture, where investment token holders will receive returns in the form of profit sharing and revenue sharing.




1. Companies or juristic partnerships that issue and offer digital tokens for public investment (in the primary market).


2. Individuals and companies or juristic partnerships that sell digital tokens for investment (in the secondary market).


The deputy government spokesman, Rachada Dhnadirek, said that companies will be able to access alternative ways of raising capital through investment tokens, in addition to tradition methods like debentures. Thai government estimates that there will be 128 billion baht ($3.71 billion) worth of investment token offerings over the next two years, and it is estimated that Thai government would lose tax revenue worth 35 billion baht ($1 million).

After Thai Securities Exchange Commission began regulating digital assets, cryptocurrencies have gained popularity in Thailand in recent years. On 8 March 2022, Thailand’s cabinet relaxed tax rules in crypto trading to promote industry development, and the rules allowed traders to offset annual losses against gains for taxes due on cyptocurrency investments, and exempted value-added-tax of 7% for cryptocurrency trading on authorized exchanges. Being effective from April 2022 to December 2023, the tax exemption would also cover trading of retail central bank digital currency to be issued central bank.

泰國證券交易委員會開始監管數位資產後,加密貨幣近年來開始在泰國流行。泰國內閣為促進產業發展,放寬加密貨幣交易的稅收規定,在2022年3月8 日規定允許交易者將每年的損失折抵對加密貨幣投資應繳稅款的收益,並免除加密貨幣交易在授權交易所7%的增值稅。生效期間從2022年4月到2023年12 月,免稅政策還包含央行發行的央​​行數位貨幣的交易的零售。

However, in September 2022, Thailand's financial regulator banned crypto companies from offering staking and lending services, established stricter crypto advertising rules, and has more recently issued regulations for crypto custody. Its central bank has also been involved in international projects to test central bank digital currencies.
